{"id":27289,"date":"2023-10-25T13:05:33","date_gmt":"2023-10-25T17:05:33","guid":{"rendered":"http:\/\/blog.residences-quebec.ca\/fr\/?p=27289"},"modified":"2023-10-25T15:57:26","modified_gmt":"2023-10-25T19:57:26","slug":"la-reprise-dun-logement-a-lage-de-70-ans","status":"publish","type":"post","link":"https:\/\/residences-quebec.ca\/blog\/la-reprise-dun-logement-a-lage-de-70-ans\/","title":{"rendered":"La reprise d\u2019un logement \u00e0 l\u2019\u00e2ge de 70 ans"},"content":{"rendered":"<p>Depuis juin 2016, la loi 492 modifie les conditions de la reprise de logement et de l\u2019\u00e9viction pr\u00e9vues dans le Code civil afin de prot\u00e9ger les droits des a\u00een\u00e9s.<\/p>\n<p><strong>La modification de la loi 492<\/strong><\/p>\n<blockquote><p>Les nouvelles dispositions l\u00e9gislatives viennent encadrer plus \u00e9troitement les conditions selon lesquelles un locateur peut \u00e9vincer un locataire a\u00een\u00e9 pour subdiviser un logement, l&rsquo;agrandir substantiellement ou en changer l&rsquo;affectation, ou pour le reprendre afin de s&rsquo;y loger ou de loger un de ses proches admissibles.<\/p><\/blockquote>\n<p><strong>Les crit\u00e8res auxquels vous devez r\u00e9pondre<\/strong><br \/>\nLe propri\u00e9taire <strong>ne peut reprendre un logement ou en \u00e9vincer un locataire<\/strong> lorsque ce dernier ou son conjoint, au moment de la reprise ou de l\u2019\u00e9viction, r\u00e9unit ces trois crit\u00e8res :<\/p>\n<p>1. il est \u00e2g\u00e9 de 70 ans et plus;<br \/>\n2. il occupe le logement depuis au moins 10 ans;<br \/>\n3. son revenu est \u00e9gal ou inf\u00e9rieur au <a href=\"http:\/\/www.habitation.gouv.qc.ca\/fileadmin\/internet\/documents\/partenaires\/acceslogis\/PRBI2016.pdf\">revenu maximal<\/a> lui permettant d&rsquo;\u00eatre admissible \u00e0 un logement \u00e0 loyer modique.<\/p>\n<p><strong>Les r\u00e8gles g\u00e9n\u00e9rales de reprise d\u2019un logement<\/strong><br \/>\nLe propri\u00e9taire peut reprendre un logement pour s\u2019y loger ou pour y loger les personnes suivantes :<\/p>\n<ul>\n<li>son p\u00e8re, sa m\u00e8re, ses enfants;<\/li>\n<li>tout autre parent ou proche dont il est le principal soutien mat\u00e9riel ou moral;<\/li>\n<li>un ex-conjoint dont il demeure le principal soutien, mat\u00e9riel ou moral, ceci apr\u00e8s leur s\u00e9paration de corps par jugement, leur divorce ou la fin de leur union civile;<\/li>\n<li>un locataire d\u00e9sign\u00e9 \u00e0 titre de personnel soignant afin de l\u2019aider \u00e0 subvenir \u00e0 ses besoins essentiels pour demeurer \u00e0 domicile.<\/li>\n<\/ul>\n<p><strong>Les exceptions<\/strong><br \/>\nLe propri\u00e9taire peut aussi reprendre le logement dans l\u2019une ou l\u2019autre des situations suivantes :<\/p>\n<ul>\n<li>il est lui-m\u00eame \u00e2g\u00e9 de 70 ans ou plus et souhaite reprendre le logement pour s\u2019y loger;<\/li>\n<li>le b\u00e9n\u00e9ficiaire de la reprise est \u00e2g\u00e9 de 70 ans ou plus;<\/li>\n<li>il est un propri\u00e9taire occupant \u00e2g\u00e9 de 70 ans ou plus et souhaite loger, dans le m\u00eame immeuble que lui, un b\u00e9n\u00e9ficiaire \u00e2g\u00e9 de moins de 70 ans.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Depuis juin 2016, la loi 492 modifie les conditions de la reprise de logement et de l\u2019\u00e9viction pr\u00e9vues dans le&#8230;<\/p>\n","protected":false},"author":27,"featured_media":27290,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3],"tags":[],"class_list":["post-27289","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-habitation-a-la-retraite"],"better_featured_image":{"id":27290,"alt_text":"reprise d'un logement","caption":"53316902 -
